Welcome to Happy Day Play (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of www.happydayplay.com (the “Site”) and participation in any Programs and Events offered by Happy Day Play.

For purposes of these Terms, “Programs and Events” includes all classes, workshops, enrichment programs, private sessions, birthday parties, special events, and related services offered by Happy Day Play, whether conducted at JCC facilities, private residences, third-party venues, or other locations.

By accessing the Site or enrolling in Programs and Events, you agree to be bound by these Terms.

If you do not agree, please discontinue use of the Site.

1. Eligibility

You must be at least 18 years old to register a child for participation in Programs and Events.

By registering, you represent and warrant that you are the child’s parent or legal guardian or are otherwise authorized to act on behalf of the parent or guardian.

Children may not independently submit personal information through the Site.

2. Registration & Third-Party Platforms

Registration for certain Programs and Events may occur through third-party platforms, including but not limited to JotForm and the JCC of Staten Island.

You agree that:

  • All information provided during registration is accurate and complete.

  • You will promptly update any changes.

  • Your use of third-party platforms may also be subject to their respective terms and policies.

3. Refunds, Cancellations & Transfers

Programs and Events Conducted at the JCC

All Programs and Events conducted at the JCC are subject to the registration terms indicated at the time of enrollment.

As stated on the registration form, fees for Programs and Events at the JCC are non-refundable and non-cancelable. In the event of cancellation of events due to Happy Day Play or JCC, refunds will be issues or credits will be distributed for another program or event.

If you are unable to attend scheduled sessions, you may transfer or gift remaining sessions to another family, subject to availability and prior written notice to Happy Day Play.

No credits, refunds, or make-up sessions will be provided for missed classes unless otherwise required by law.

By completing registration or payment, you acknowledge and agree to these refund and cancellation terms.

Birthday Parties & Private Events

Birthday parties, private events, and entertainment services require a deposit to secure the date.

Deposits are non-refundable.

All remaining balances, cancellation terms, and rescheduling policies are governed by the separate Party or Event Contract provided at booking.

In the event of cancellation, refunds (if any) will be determined solely in accordance with that agreement.

Schedule Changes

Happy Day Play reserves the right to modify schedules, instructors, venues, or event details due to unforeseen circumstances, including but not limited to illness, venue restrictions, weather, or safety considerations.

If a Program or Event must be canceled by Happy Day Play, reasonable efforts will be made to reschedule or provide an alternative solution at our discretion.

4. Program Locations & Inherent Risks

Programs and Events may be conducted at:

  • JCC facilities

  • Private residences

  • Third-party event venues

Each environment may present different physical conditions.

Participation in recreational and movement-based Programs and Events involves inherent risks, including but not limited to:

  • Slips and falls

  • Collisions with participants or equipment

  • Uneven surfaces

  • Environmental conditions

By enrolling in Programs and Events, you acknowledge and voluntarily accept these inherent risks on behalf of your child.

5. Third-Party Venue Responsibility

When Programs and Events are conducted at private residences or third-party venues:

  • The property owner or host is responsible for maintaining a reasonably safe environment.

  • Happy Day Play is not responsible for the structural condition, maintenance, or general safety compliance of host premises.

6. Supervision

While reasonable care is exercised during Programs and Events, group activities involve multiple participants and dynamic movement.

Continuous one-to-one supervision is not guaranteed unless explicitly agreed upon in writing.

Parents and guardians remain responsible for supervising their child before and after Programs and Events unless otherwise specified.

7. Health & Participation

Participants should not attend Programs and Events if experiencing symptoms of illness or contagious conditions.

Happy Day Play reserves the right to refuse participation to protect the health and safety of others.

Parents are responsible for disclosing known medical conditions, allergies, or special needs relevant to participation.

While reasonable precautions may be taken, Happy Day Play cannot guarantee an allergen-free environment.

8. Educational & Informational Content

Content provided on this Site, including blog posts, articles, and educational materials, is for general informational purposes only.

It is not intended as medical, psychological, therapeutic, legal, or professional advice.

Parents and caregivers should consult qualified professionals regarding specific concerns about their child’s health, development, or well-being.

Reliance on any information provided on the Site is at your own risk.

9. No Guarantee of Outcomes

While Programs and Events are designed to support learning, movement, and development, individual results may vary.

Participation in Programs and Events does not guarantee specific developmental, educational, behavioral, or social outcomes.

10. Media & Photography

Participation in registration may include the opportunity to grant or decline consent for photography and video use related to Programs and Events.

Any media consent provided is voluntary and governed by our Privacy Policy.

Unless explicit consent is provided, no child’s image will be used for promotional purposes.

11. Privacy

All personal information submitted through the Site or during registration for Programs and Events is governed by our Privacy Policy, which is incorporated herein by reference.

12. Intellectual Property

All content on the Site, including text, graphics, logos, educational materials, lesson plans, and digital content, is the property of Happy Day Play or its licensors and is protected by intellectual property laws.

No content may be copied, reproduced, distributed, or used for commercial purposes without prior written consent.

13. Insurance

Happy Day Play maintains its own general liability insurance coverage for its operations.

Coverage is subject to the terms, conditions, exclusions, and limitations of the applicable insurance policy.

Nothing in these Terms shall be construed as a guarantee of coverage in any particular circumstance.

14. Disclaimers

THE SITE AND ALL PROGRAMS AND EVENTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Happy Day Play disclaims all warranties, including but not limited to merchantability and fitness for a particular purpose.

15. Limitation of Liability

To the fullest extent permitted by law, Happy Day Play shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from participation in Programs and Events or use of the Site.

In no event shall our total liability exceed the amount paid for the applicable Program or Event, except where prohibited by law.

16. Indemnification

You agree to indemnify and hold harmless Happy Day Play, its instructors, employees, contractors, and affiliates from any claims, damages, losses, or expenses arising from:

  • Your violation of these Terms

  • Failure to disclose relevant medical or safety information

  • Misuse of the Site

  • Your actions or omissions related to participation in Programs and Events

17. Independent Program Provider

Happy Day Play operates as an independent program provider and may collaborate with the JCC of Staten Island, Babies R Us, or other venues.

Nothing in these Terms creates a joint venture, partnership, or employment relationship beyond program collaboration.

18. Governing Law

These Terms shall be governed by the laws of the State of New York and New Jersey.

Any dispute arising out of these Terms or participation in Programs and Events shall be brought exclusively in the state or federal courts located in New York and New Jersey.

19. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site or participation in Programs and Events after updates are posted constitutes acceptance of the revised Terms.
